Addressing Prison Overcrowding in Northern Bahr El Ghazal

Prison overcrowding in Aweil East County and Aweil Central Prisons within Northern Bahr El Ghazal remains a pressing issue, impacting both inmates and the wider justice system. The lack of adequate living conditions, insufficient legal representation, and limited awareness of legal rights contribute to human rights violations, undermining justice and fairness. This situation affects not only the well-being of inmates but also their chances of rehabilitation and reintegration into society, exacerbating cycles of crime and recidivism.

UNDP’s Comprehensive Strategy for Justice and Legal Reform

The UNDP Access to Justice Programme is actively addressing these challenges by implementing a comprehensive, multi-stakeholder approach in alignment with the Rule of Law Forum. With funding from the Kingdom of Netherlands and through strategic partnerships with the State High Court, Ministry of Justice, South Sudan National Police Service, South Sudan Bar Association, State Human Rights Commission, and National Prison Service, UNDP is championing solutions to mitigate overcrowding and enhance justice delivery.

Key Strategies and Interventions

Enhancing Living Conditions and Human Rights Protections: The programme prioritizes improving prison conditions and ensuring the protection of inmates’ rights as fundamental aspects of upholding human dignity. By addressing inadequate facilities and advocating for fair treatment, UNDP reinforces the Rule of Law Forum’s commitment to justice and equity.

Reducing Overcrowding Through Legal Reforms: Promoting legal compliance and advocating for early release programs contribute to a fairer justice system and reduced strain on detention facilities.

Rehabilitation and Reintegration Initiatives: UNDP places a strong emphasis on rehabilitation, ensuring that inmates receive the necessary skills, psychological support, and social reintegration programs to foster their transition back into society. By aligning with the Rule of Law Forum's objectives, these efforts aim to reduce recidivism rates and provide a sustainable pathway for former inmates to lead productive lives.

Monthly Legal Aid and Prison Visits: These visits are crucial in providing immediate support and empowering inmates. By reinforcing their understanding of legal rights and ensuring access to justice, the programme strengthens the fundamental principles of the Rule of Law, fostering a fairer and more transparent legal system.

Impact and Progress

As a result of these interventions, significant strides have been made in alleviating prison overcrowding. As of March 2025, a total of 254 individuals (25 women and 229 men) have benefited from early release initiatives. This milestone underscores UNDP’s dedication to fostering a more just and equitable society by strengthening legal frameworks and protecting human rights.
