Mediation and Arbitration for Dispute Resolution

A joint initiative of the European Union (EU) and UNDP to enhance access, use and efficiency of mediation and arbitration and improve business and investment environment and access to justice

Summary

Mediation and Arbitration for Dispute Resolution is a joint initiative of the European Union (EU) and United Nations Development Programme (UNDP). Working closely with the Government of Georgia, judiciary, private sector and educational and professional institutions, the European Union and UNDP will continue promoting the use of mediation and arbitration in civil and commercial disputes, enhancing the access to professional mediation and arbitration services in Georgia, thus assisting the country to improve the business environment and access to justice.

Improvement of Georgia’s business and investment environment has been defined as one of the key priorities of the EU-Georgia Association Agenda, which reiterated the need to develop Alternative Dispute Resolution (ADR) mechanisms to facilitate economic development, improve the business environment and ensure a better legal system and access to justice.

The new phase of assistance to Alternative Dispute Resolution in Georgia builds on the results of two EU-UNDP joint initiatives – Justice for All (2016-2018) and Enhanced Mediation and Arbitration for Fairer and Faster Commercial Dispute Resolution (January 2019- March 2021). With a budget of EUR 264,700, the project is being implemented in 2021, contributing to the EU’s larger programme EU4Business as well as to Georgia’s progress in achieving Sustainable Development Goals.

Expected results

The project is expected to deliver results under the following areas:

  1. Enhanced access to and efficiency of mediation and arbitration.
  2. Access to professional mediation and arbitration services.

The specific results include:

  • Better access to and efficiency of mediation and arbitration.
  • Increased awareness on mediation and arbitration.
  • Developed institutional capacity of professional associations of mediators and arbitrators.
  • Enhanced capacities of the judiciary and legal professionals in ADR to provide quality legal services in civil and commercial disputes.
